Members of CohnReznick Benefits's Health & Benefits and Compensation & Human Capital practices will be presenting "Impact of Proposed Changes to FLSA Overtime Rules" at the forthcoming Connecticut Association of Independent Schools Business Manager's Meeting. The presentation will address the latest in FLSA changes to "White-Collar" exemptions and the financial, organizational and operational impact these changes will have on many employers. The presentation will also cover:

  • The expected timeframe for implementation of changes in order to be in full compliance
  • The recordkeeping requirements for payroll and hours worked
  • Identifying compensation issues that may be raised and strategies to deal with these in the context of proposed changes to EEO-1 pay data reporting

2016 Webinar Series - "Key Implications of Proposed Changes to FLSA Overtime Rules and Pay Data Reporting" Wednesday, March 23, 2016

The DOL's proposed FLSA changes to 'White-Collar' exemptions is one of the most pressing human capital issues employers will need to address this year. Final Rules may be issued sometime this summer and could have a significant financial, operational and organizational impact on many employers. Full compliance with Final Rules will be necessary within a short time frame so advance preparation is critical.

Compensation administration practices may need to be revisited and should be considered in the context of the new Equal Employment Opportunity Commission's (EEOC) proposed rulemaking that revises the Employer Information Report (EEO-1) data collection requirements to include pay data.

At this event we will discuss these proposed changes and identify key issues. We will explore what employers should be doing to address employee concerns, and protect themselves from potential wage claims or misclassification liability as a result of these proposed changes.

2015 Webinar Series - Understanding The ABC's of the IRC ACA Reporting Requirements Tuesday, March 31, 2015

IMPORTANT NOTE: This webinar is appropriate for Applicable Large Employers - those with 50+ full-time equivalent employees in 2014 who are subject to the new ACA reporting requirements under IRC 6055 and 6056. Smaller employers that either offer (a) no health coverage or who (b) offer employees insured group health coverage (including through a SHOP exchange) are not subject to this ACA provision.

The ACA employer mandate has begun (with some exceptions) and new reporting forms must be completed and issued to the IRS and employees for 2015. Applicable Large Employers must be able to properly categorize, capture and classify an employee's status and healthcare coverage on a monthly basis. The IRS has issued final versions of Forms 1094 and 1095 (actually there are three versions of the forms referred to here as the "A","B" and "C" series) and employers are wrestling with what needs to be done to comply with the new reporting requirements.

In this webinar we will help you understand your ACA reporting obligations by answering such questions as:

+ What is the purpose of these reports?
+ Who is responsible to prepare and issue these reports and to whom?
+ When and how must these reports be issued?, and
+ Which forms do employers use?: Is it the "A" series, the "B" series or the "C" series of Forms 1094 and 1095; what parts of the forms must be completed and and how is the information reported. We will also show you some examples of how to complete these forms for different types of employees and employer plans.

The ACA continues to roll out - the employer mandate has begun (with some exceptions) and reports to the IRS and employees for 2015 require the ability for applicable large employers to properly categorize, capture and classify an employee's status and healthcare coverage on a monthly basis. The rules are quite complex and certain mistakes may be costly. You might think that your payroll and/or HRIS vendor has everything under control; however employers bear the responsibility when things stray off course because of detours that may be encountered.

In this first webinar for 2015 we will review some challenges the ACA may present (and how to avoid potential pitfalls) as you prepare for the new reporting requirements. This session will help you answer such questions as:

+ Are you properly tracking hours of service for hourly paid and non-hourly paid (e.g. salaried) employees?

+ What measurement method are you using to determine an employee's full-time status (hint: Monthly Measurement or Look-Back Measurement) and do you understand how you may apply these methods to various categories of employees?

+ How is "full-time status" impacted (and reported) during a leave-of-absence, increase or decrease in regularly scheduled hours, or when an employee experiences a break-in-service (and when may COBRA need to be offered)?

+ What changes can you make to your Section 125 "change-in-status" rules?

+ Do your policies or handbooks need to be modified to reflect the new world of ACA "full-time" employees?

What Employers Need To Know About The New Healthcare Exchange Offerings and The Rules That Apply, April 25th, 2PM-3PM. Effective October 1, 2013 individuals and small employers will have the ability to enroll in the new healthcare exchanges for coverage to become effective January 1, 2014. These new online marketplaces will be set up in all 50 states and the District of Columbia, and will be required to offer certain types of comprehensive coverage to members. Small employers will need to know if they qualify to purchase group coverage on the exchange and what rules apply with regard to open enrollment, plan selection and administration. Large employers will also be interacting and sharing information with the Exchanges regarding employees who may elect coverage from an Exchange in order to understand if penalties could arise.
